This Privacy Policy describes how the Maracaibo community website (the “Website”) collects, uses, discloses, and protects personal information about members and visitors. Maracaibo does not sell, rent, or trade personal information to third parties. We may disclose personal information in limited circumstances, including:

  • To service providers who assist in operating the Website, provided they are bound by confidentiality obligations no less protective than this policy
  • To other verified members, but only where you have consented to inclusion in a community directory
  • To board and strata council members acting in their official capacity for community administration purposes

12. Access to and Correction of Personal Information
You have the right under PIPA to request access to the personal information we hold about you and to request correction of any inaccuracies. To make such a request:

  • Submit your request in writing to the Privacy Officer
  • Provide sufficient information to verify your identity and locate your records
  • We will respond within 30 business days of receiving your request, or notify you if additional time is required

Maracaibo may refuse access in limited circumstances permitted by PIPA, such as where disclosure would reveal personal information about a third party, or where the information is subject to legal privilege. If we refuse access, we will advise you in writing of the reason for the refusal and inform you of your right to request a review by the OIPC.
13. Service Provider and Cross-Border Data Transfer
The Website is operated using MemberLeap, a cloud-based association and community management platform. Our agreement for this service is with LSG Canada Inc., doing business as Lighthouse Software Group, a wholly owned subsidiary of Valsoft Corporation, a Canadian company headquartered in Montreal. MemberLeap was founded in 2000 and is headquartered in Lansing, Michigan, and continues to operate autonomously within the Valsoft portfolio.
MemberLeap stores and processes member data on servers located in the United States of America. By registering as a member and using the Website, you acknowledge and consent to your personal information being transferred to and stored in the United States.
The United States does not have privacy laws equivalent to PIPA or the laws of British Columbia. As a result, your personal information may be subject to access by U.S. courts, law enforcement, or government authorities under U.S. law. We have taken the following steps to protect your information in this context:

  • We have entered into a data processing agreement with LSG Canada Inc. requiring it to protect personal information using standards consistent with PIPA
  • Access to member data within MemberLeap is restricted to authorised Website administrators
  • LSG Canada Inc. is contractually required to use your personal information only to provide the community platform service and for no other purpose

14. Children’s Privacy and Event Photography
14.1 Children’s Use of the Website
The Website is intended for use by adult members and property owners of Maracaibo. We do not knowingly collect personal information directly from individuals under the age of 13 through the Website. The Website allows for adult members to add family details including children and grandchildren to the member directory, at their discretion. If you believe we have inadvertently collected such information, please contact the Privacy Officer.
14.2 Photographs of Children at Community Events
Maracaibo occasionally photographs or videos community events, such as neighbourhood gatherings, seasonal celebrations, and recreational activities, where children of members may be present. We may publish such photographs on the Website or in community communications for the purpose of fostering community spirit and documenting community life.
Because photographs of identifiable children constitute personal information under PIPA, we handle event photography of minors as follows:

  • A member who does not wish their child to be photographed at an event, should notify the event organiser or the Privacy Officer prior to or at the event
  • Upon registering as a member, you may provide standing consent for photographs of your children to appear on the Website. You may withdraw this consent at any time by contacting the Privacy Officer
  • Where a member raises an objection after an image has been published, we will remove the image promptly upon receiving a written request
  • We do not publish images of children that include personally identifying information such as full name, school, or address alongside the photograph
  • Photographs published on the Website are accessible only to verified members and are not made publicly available on the open internet

If you have concerns about a photograph of your child that has appeared on the Website, please contact the Privacy Officer as set out in Section 3.

This Website may contain links to third-party websites or services. We are not responsible for the privacy practices of those third parties. We encourage you to review the privacy policies of any third-party websites you visit.
